Denmark Must Change Online Gambling Laws

According to reports from eGaming Review, the European (EC) has given one month to the Danish Government for them to amend its draft law to regulate online gambling and betting so that it is in accordance with EC law.

Danish Government has been given until 9th November to respond to the opinion against their proposal. During this time the Government cannot adopt the legislation under the threat that the commission will launch infringement proceedings.

The EC found many key provisions within the current proposal which are in conflict with EC law including a continued monopoly on inter alia pool betting for horse racing and the introduction of blocking internet service provider and financial transactions. In addition to this a marketing ban and the failure of taking into account the securities and controls which are already offers by other EU jurisdictions.

EGBA secretary general Sigrid Ligné said the organization do support the regulated opening of the online gaming market in Denmark, however the liberalization must be in compliance with EC law.

Ligne said, “We welcome the European Commission´s continued resolve to ensure that all gaming and betting legislation in the EU complies with the core principles of the EC Treaty.”

The draft law was submitted to the European Commission on 7th July 2009, the EC returned its detailed opinion yesterday.
