New York Lottery to face Lawsuit

Gameologist Group have filed a lawsuit against the New York Lottery along with Scientific Games Incorporated for alleged trademark infringement.
Gameologist is based in the eastern state of New Jersey and has filed the lawsuit regarding the Bada Bing scratch card in the New Jersey Federal District Court. The scratch card game was manufactured by Scientific Games before being released by the New York Lottery in December 2007. However Gameologist claims that this game called Bling Bling, which was registered with the US Patent and Trademark Office in 2003.
Gameologist stated that “it met with representatives of scientific Games in 2003 and had correspondence with the New York Lottery in 2004 concerning ‘Bling Bling’ but that both claimed at the time the game was ‘too ethnic’ and ‘did not meet Lottery saleability standards’.”
Craig Stuart one of the lawyers representing Gameologist through New York’s Balestriere Lanza law firm said, “This small company is due millions of dollars in damages under the Lanham Act,” and “This case is about two large companies stealing a small businesses protected property believing, that Gameologist would not have the means to sue.”
Gameologist revealed that the New York Lottery has made as much as $24 million in profits from the game ‘Bada Bing’ after selling roughly 16 million tickets at $10 each and it is asking the New Jersey Court to enforce $24 million in compensation alongside treble damages.
